Repeat sex offender arrested, charged with 2012 rape

An Elkhart man faces 153 years in behind bars, accused of raping a woman and threatening to kill her. Police arrested Jerry Wayne Young, 49, on July 31st in connection to a 2012 rape.

According to court documents, the Elkhart County Prosecutor’s Office charged young with rape and criminal deviant conduct, both Class A Felonies, intimidation, a Class D felony, in addition to enhancements as a repeat sexual offender and a habitual criminal offender.

The probable cause affidavit alleges Young knocked on the victim’s door at 3:00 a.m. on October 16, 2012. Knowing Young as “Jeremy,” an acquaintance,” she opened the door. He entered the home without invitation, telling the woman he wanted to “hang out” and “have fun.”

When the victim refused and reached for her phone, Young allegedly took it, pushed her on the couch and tried to take off her pants, according to charging documents. As the incident progress, Young forced the woman to undress herself as he threated to hit and kill her.

The court record indicates Young raped the woman two times and forced her to perform oral sex on him when he said he wasn’t “satisfied.” When he finished, he lit a cigarette inside her home. The woman escaped by telling Young she needed to get a lighter from outside despite Young’s threats to shoot her if she didn’t return.

The victim called police and went to a nearby hospital for a rape kit exam. It wasn’t until January of 2013 that a friend of the female victim identified Young as he stepped off a trolley in downtown Elkhart. A DNA sample taken shortly thereafter matched Young’s DNA with genetic material from the victim’s rape kit and the recovered cigarette at the victim’s home.

Prosecutor’s issued a warrant for Young’s arrest in May of 2015, roughly one and a half years after the reported rape. A representative for the Elkhart County Prosecutor’s Office said the delay in charges can be attributed to short staffing of attorneys specializing in sexual abuse cases.

Young faces 153 years for the charges, but his criminal history could add even more years to his sentence.

He has been arrested for public intoxication, disorderly conduct, resisting arrest, battery on a police officer, deception, invasion of privacy. But most notably on Young’s rap sheet, convictions for sexual battery and sexual misconduct with a minor.

In 2000, prosecutor’s charged Young with two counts of rape and one count of sexual battery. After a trial, the jury dismissed the two rape charges only to convict Young of sexual battery. NewsCenter 16 requested copies of the narrative and charging information regarding the assault.

Three years later Young found himself in front of the court again, this time for sexual misconduct with a minor. According to court documents, young entered the bedroom of his friend’s 14-year-old daughter. The girl told her mother that Young began touching her “booty.” The girl reportedly worse long pants and now underwear, she told investigators Young touched her butt over her clothes and rubbed her intimately.

Young spent three years in prison for the child sexual misconduct charge.

His next court appearance for the 2012 rape is scheduled for August 24, 2015.
