Ron White performs at Lerner Theatre, allegedly violates smoking ordinance

Just days after Elkhart Mayor Tim Neese said he's planning to veto a repeal of Elkhart's Clean Air Ordinance, a witness told NewsCenter 16 that comedian Ron White allegedly smoked a cigar during his Thursday night performance at the Lerner Theatre.

Smoking in public buildings is against the ordinance, as well as Indiana law. As a result of the alleged violation, the Lerner Theatre could face a $1,000 fine.

Last week, Elkhart's City Council voted to repeal its Clean Air Ordinance. Council members were initially trying to figure out a way to legally allow White to smoke during his performance. White is known to smoke a cigar as part of his comedy act.

Council members wanted to allow bar and tavern owners to decide if they should allow smoking in their businesses, however health advocates expressed concern about the decision.

The repeal was sent to Mayor Neese, and Neese has signaled that he will veto it. Despite the repeal, smoking in public is still in violation of state law.
