New trial granted in file-sharing case

Looks like the legal equivalent of a reboot in the nation's first file-sharing trial. A federal judge in Minneapolis has granted a new trial to a woman who was convicted of pirating music files.

Looks like the legal equivalent of a reboot in the nation's first file-sharing trial. A federal judge in Minneapolis has granted a new trial to a woman who was convicted of pirating music files.

U.S. District Judge Michael J. Davis has granted a motion for a new trial for Jammie Thomas.

She had been found guilty of copyright infringement for offering to share 24 songs on the Kazaa file-sharing network.

She was ordered to pay $220,000 to six record companies. But the judge said yesterday that he made an error in the jury instructions that he says "substantially prejudiced" her rights.

At the same time as granting the new trial for Thomas, Davis is calling on Congress to change copyright laws to prevent excess awards in similar cases.
