A woman ordered to pay a six-figure amount in a music downloading trial may be off the hook. A judge in Minnesota has decided to open the issue of whether there should be a new trial for Jammie Thomas, who was accused of sharing copyrighted music online.

But now the judge is saying there's a question whether the record labels have to prove if anyone actually downloaded the copyrighted songs -- or whether it's enough to argue that a defendant made copyrighted music available to be copied.

In the Thomas case, the judge told the jury that the woman could be considered in violation of copyright rules if she made the music available online, regardless of whether the songs were downloaded by someone else.

Oral arguments on the question of a new trial are set for July.

Scream 1st amendment rights until your face is blue and you may have a shot. What's illegal about posting information on the internet? It is not your responsibility to safe-guard data on the internet or prevent individuals from downloading data.
