Democrats file legal challenge to Ind. House fines

Indiana House Democrats are seeking a restraining order against the $1,000-a-day fines they face for their legislative boycott over the right-to-work bill.

Indiana House Democrats are seeking a restraining order against the $1,000-a-day fines they face for their legislative boycott over the right-to-work bill.

A motion seeking the order was filed Wednesday in an Indianapolis court.

Democratic leader Patrick Bauer says he believes the House leadership doesn't have the legal authority to deduct the fines from pay checks of members. A similar court challenge is pending from fines imposed on boycotting Democratic legislators last year'.

Attorney General Greg Zoeller asked the court to deny the restraining order. He says, "The legislative process is often compared to `making sausage,' and courts should stay out while the
blades are moving."

House Republicans voted Wednesday to impose the fines after most Democrats stayed off the floor of the House for the fifth time this
month.
