MADISON CO., Ind.--- According to our sister station WTHR in Indianapolis, James Foutch has been charged in the wreck that killed one person and injured another on Sunday.
Foutch, an off-duty Edgewood Police Officer, admitted in court documents to taking hydrocodone seven hours before the crash.
Foutch was found to be driving 92 mph when he rear ended Jesse and Rebecca Sperry’s car sending it into a utility pole.
The incident happened on SR 32 in Madison County on Sunday morning.
Jesse Sperry died at the scene while Rebecca Sperry, who was also nine months pregnant, was rushed to a local hospital. She delivered her baby during an emergency C-section. She and her newborn baby are recovering from their injuries and will return home soon.
Foutch is being charged with operating a vehicle while intoxicated causing death, along with some other charges. Prosecutors are still awaiting toxicology results.
