Trade group files suit over cold beer sales law

A trade group representing convenience stores and gas station owners is suing the state after failing to get the Legislature to change an Indiana law allowing only liquor stores and bars to sell cold beer.

The Indiana Petroleum Marketers and Convenience Store Association filed a lawsuit Tuesday in federal court in Indianapolis that calls Indiana's law arbitrary and discriminates against grocery and convenience stores. The lawsuit contends Indiana is the only state that regulates the temperature beer may be sold at and that there's no legitimate purpose for the restriction.

The lawsuit names the state, the Indiana Alcohol and Tobacco Commission and its chairman as defendants. It also contends the resulting lack of competition hurts consumers through higher prices.

A message seeking comment was left with the commission.
