Man sues South Bend for noxious sewage gas entering home

The city of South Bend is being sued by a man who claims that noxious gas entered his home through the sewer system.

The lawsuit alleges that the problem can be tied to discharges from the New Energy Ethanol Plant. The plant, which ejects waste into the sewer system, is on the same sewage line that flows past the home of Raymond Kerr on 240 South Meade St.

Additionally, the suit claims that waste from the ethanol plant often solidifies and blocks the sewer line, thus forcing gas and other noxious fumes into the home.

Kerr says that the fumes made it so difficult to breath inside his own home that he had to leave.
