Elkhart molestation conviction reversed

Elkhart, Ind. An Elkhart County man, sentenced to 30 years for child molestation, has had his convictions reversed.

The Indiana court of appeals ruled that Tim Hyser did not get to present a complete defense at trial.

Hyser was convicted of molesting a young boy who lived next door.

But the jury never got to hear Hyser's contention that the boy was being physically assaulted by his mother's live-in boyfriend.

And that the molestation charges came in retaliation for Hyser reporting the abuse.

The court of appeals ruling stipulates that Hyser can be tried again.
