Elkhart man accused in home improvement fraud is no-show in court

A man you may remember from several NewsCenter 16 investigations was expected in an Elkhart County courtroom today on charges of home improvement fraud.

A man you may remember from several NewsCenter 16 investigations was expected in an Elkhart County courtroom today on charges of home improvement fraud.

But Gary Franklin, who's a habitual offender, was a no-show in court.

Apparently, Franklin had already pleaded guilty to his charges and was expected to be in court for sentencing this morning.

Newscenter 16 was there as Franklin failed to show up and we spoke with his lawyer about what happened.

"Today, Mr. Franklin failed to appear for the scheduled sentencing hearing,” explained defense attorney Gary Griner. “The judge issued a warrant for his arrest. It's expected when he is arrested he'll be held in jail until such time as he's actually brought to court to be sentenced"
The prosecution asked Franklin be held without bond, which the judge granted.
