Muncie police are conducting an internal investigation to determine what led to the arrest of two men after a police officer said he saw one of them cut in line at a Wal-Mart.

Off-duty officer Chris Kirby arrested 26-year-old Edward Pluhar Jr., and his father 61-year-old Edward Pluhar Sr., after a scuffle in the store parking lot on Sunday.

Edward Pluhar Jr. says a clerk waived him to the front of the line at the store's service desk after he picked up a remote control for an exchange.

Kirby's attorney, Mark Delgado, says he's certain Kirby will be cleared by the investigation.

Deputy Police Chief Roc Barrett says the internal investigation is an effort to "get our facts straight," because of the attention the incident received.
