Charges against an Evansville man accused of shaking his 5-month-old son to death have been dismissed due to lack of evidence.

The Evansville Courier & Press reports the charges of murder and battery resulting in death against 20-year-old Charles Lipson Jr. were dismissed Tuesday in Vanderburgh Superior Court.

Lipson remains in jail on an unrelated charge.

Lipson's son, Railan Barrett, died June 9 at an Indianapolis hospital where he was airlifted after he suffered an apparent seizure a few days earlier. A man identifying himself as the child's father told 911 dispatchers the boy fell off a bed.

A police affidavit said a neurosurgeon concluded the child's injuries were consistent with being shaken.

The charges were dismissed without prejudice, meaning Lipson could be charged again.
