Plymouth wins lawsuit brought by reserve airman

PLYMOUTH, Ind.--- A judge has ruled in favor of the City of Plymouth in a federal lawsuit brought by a reserve airman.

The U.S. Attorney's Office filed a complaint against Plymouth in 2012 after denial of seniority based benefits for Air Force Reservist Mike Delee.

Delee was put on active duty for eight months from 2010 to 2011.

When he returned he was given back his job as a patrolman for the Plymouth Police Department, but was not given longevity pay.

The lawsuit claimed the city violated federal laws, but today's ruling determined that the law allows Plymouth to reduce longevity pay for the time Delee missed work while on active duty.
