Mayoral recall election back on in Benton Harbor

A mayoral recall election in Benton Harbor will now go on.

Back in May the recall was called off but now after a judge’s ruling that's changed.

In May the Berrien County Clerk's Office disqualified signatures on the petitions that were signed twice.

Now months later after reviewing the petitions, a judge says that decision violates First Amendment rights.

So basically the duplicate signatures are being counted for at least one vote. It basically means that the petition now has enough signatures to trigger a recall election at the ballot in November.

Edward Pinkney, who pushed for the recall, says, “I believed in the hearing once they reviewed the evidence that the recall would be set for November. I knew it would be.”

Mayor Hightower declined an on-camera interview today but he did send out a statement.

He essentially said he was disappointed in the decision and would be campaigning his position like he planned the first time around.
