An Elkhart man says he is guilty of dealing cocaine, but pleads ignorance when it comes to how close he sold the drug to a nearby school.

An Elkhart man says he is guilty of dealing cocaine, but pleads ignorance when it comes to how close he sold the drug to a nearby school.

According to the Elkhart Truth, Patrick Wallace, 22, is charged with two counts of dealing cocaine within a 1,000 feet radius of a family housing complex, one count of dealing cocaine within 1,000 feet of a school, and an additional count of dealing more than three grams of the drug.

On March 28, Wallace appeared in court anticipating a guilty plea to all the charges, but was surprised to learn the facts of the third charge when Elkhart Circuit Court Judge Terry Shewmaker announced he was charged with dealing cocaine near a school.

Wallace consulted his attorney and said he was unaware he was within 1,000 feet of Mary Daly Elementary School when he delivered the cocaine.

The probable cause affidavit for his case explains that the Elkhart Police Dept. Drug Unit made three purchases of crack cocaine from Wallace in August and September of last year. According to the document, on Aug. 29, Wallace met with a source who bought $50 worth of cocaine within an estimated 200 feet from LaCasa Family Housing Complex.

On Sept. 4, that source bought the drug at the same location near the housing complex. About a week later, on Sept. 12, Wallace met with a source at a site about 50 feet away from Mary Daly elementary to sell $60 worth of cocaine.

Wallace was then arrested during a traffic stop after the sale. Police found the $60 from the buy as well as 21 rock-like substances that tested positive for cocaine inside Wallace’s car.

The sentencing hearing for Wallace is schedule for April 25.
