Demoted South Bend Police Chief, Darryl Boykins has filed a tort claim notice with the city indicating he may file a lawsuit.
His attorney filed the claim yesterday. It claims Boykins' demotion to captain was racially motivated. Boykins was the first black police chief in South Bend.
He resigned in March. When he tried to rescind that resignation a day later, Mayor Pete Buttigieg said it was too late.
Boykins’ attorney Thomas Dixon said at the time that the resignation was forced and done under duress.
It came amid an investigation into the police department using computer software to record and archive phone calls to emergency, dispatch and up to ten additional lines.
The city has 90 days to respond.
