There is concern among conservatives about a young liberal scholar President Barack Obama has nominated to the federal appeals court in San Francisco.
If confirmed, 39-year-old Gordon Liu could serve for decades on the 9th U.S. Circuit Court of Appeals in San Francisco. But Curt Levey of the Committee for Justice says the "bigger concern" for conservatives is that Liu could wind up on the Supreme Court. Republican Sen. Jeff Sessions has described Liu's views as "far outside" the legal mainstream.
Recent presidents chose young judges with the expectation they'd have enduring influence. Five current Supreme Court justices became appeals court judges before age 45.
Obama's other judicial picks have been considered moderate. He's nominated 51 appellate judges, and additional selections are expected in the coming months.
