The Michigan appeals court says justice isn't served by a one-sided judge.
The court threw out personal-protection orders against an Oakland County couple who were drawn into a dispute with neighbors. The judge signed the orders without giving them a chance to defend themselves.
Charles Simon is a 78-year-old retired judge from Montcalm County who was a visiting judge in Oakland County in 2008.
Andrea and Nelson Najer wanted to show a video, and 13 neighbors wanted to testify in the couple's defense. But the judge wasn't interested. Simon told them that PPO hearings are the "worst thing" in the justice system.
The appeals court said Friday that Simon violated the Najers' rights. Attorney Chuck Kronzek appealed on principle. The protection orders expired in 2009.
