The Michigan Secretary of State's office says the Wayne County clerk should ask ex-Detroit Mayor Kwame Kilpatrick to provide a letter from the Internal Revenue Service to determine whether he properly used nearly $980,000 in campaign finance funds to pay his lawyers.
The "interpretative statement" issued Wednesday advised County Clerk Cathy Garrett to send a letter to Kilpatrick asking him to seek an IRS ruling.
Garrett previously asked the Secretary of State to rule on the case but was told there was not enough information. A message seeking comment was left after hours Wednesday at Garrett's office.
The Detroit News and Detroit Free Press say Kilpatrick could face fines if he doesn't respond or the IRS determines the expenditure were illegal.
