Eliason expected in court for hearing

16-year-old Dakotah Eliason will have another chance for a new trial. He is expected in court Thursday for the continuation of his hearing by the Michigan Court of Appeals. The hearing began in December.
Eliason is charged with the killing his sleeping grandfather.
Two issues were raised to appeal the teen's life without parole sentence at the December hearing. The first was dismissed immediately. Jurors said they could not see Eliason's ankle shackles during the first trial.
The second, no one testified as to why Eliason did not show remorse after the crime. Eliason's attorney admitted he worked with three psychologists looking for an insanity plea, but nothing beyond that. The judge asked in the beginning would proving remorse have weighed in on the jury's decision anyway.
A fourth psychiatrist was goign to be called by the State Court of Appeals to discuss Eliason's possible remorse issues. Before he could be questioned by the prosecution there must be approval by the state since the records are sealed.
