One killed, two injured in buggy crash
Elkhart County, Ind. Marion Yoder, 59, was killed Tuesday when a car crashed into his buggy at the intersection of County Road 38 and County Road 31.

Marion Yoder, 59, was killed Tuesday when a car crashed into his buggy at the intersection of County Road 38 and County Road 31 around 5:45 p.m. Marion's wife Edith and his grandson Caleb, 8, were also injured in the accident.
Police tell NewsCenter 16 a Buick driven by Joshua Smoker, 34, was traveling east on C.R. 38 when it hit the buggy traveling south on C.R. 31. The family was ejected from the buggy.
Caleb suffered a head injury in the accident, but is expected to survive. A family member tells NewsCenter 16 Edith fractured her face, ribs and ankle, dislocated her shoulder and punctured a lung, but is also expected to survive.
The family was heading to Benton Elementary School for a school event.
According to a release from the Elkhart County Sheriff's Department, Smoker told investigators he did not know the buggy was going to enter his path. Edith told police she did not see Smoker's vehicle. A family member said the family waited for about a dozen cars to pass before attempting to cross the busy intersection and didn't see Smoker.
Edith told a family member once Marion pulled into the intersection, he said, "Oh no," right before the collision.
The Fatal Alcohol Crash Team is investigating the crash, but no arrests were made at the scene.
Smoker was taken to the hospital for observation, but did not have any apparent injuries at the scene.
