Attorney general files suit against VIM

The Indiana attorney general has filed a lawsuit against Elkhart County recycling company VIM.

Attorney General Greg Zoeller is in Elkhart today. He filed the suit today in Elkhart County Superior Court.

The lawsuit accuses VIM of open dumping, fire hazards and danger to employees and the public. It asks the court to require the company to cease dumping of wood waste, and to remove waste materials and debris.

Under state environmental laws, the Court could impose civil penalties against VIM of up to $25,000 per day per violation.

Zoeller said today that given its history, this illegal dumping was the last straw. "This company has been given multiple opportunities by the State of Indiana," Zoeller said. "They've just run out of second chances."

VIM has been at the center of controversy in Elkhart County for years. An explosion and massive file killed a worker and injured another in June 2007. A second worker was killed in May of this year, when he was struck in the head either by machinery or a piece of wood.

Just days later, the plant was cited by the Indiana Environmental Protection Agency for an open burning ban.

This most recent lawsuit follows a similar one filed by nearly 150 neighbors and business owners in October. That suit accused VIM of dumping thousands of tons of wood waste, which contaminated the ground and air.

Neighbors have been trying to get the plant shut down for years.
