Michael Failor, 60, of Fort Wayne was killed in a car crash Tuesday evening at the intersection of County Road 15 and County Road 32, west of Goshen.

A witness told police just after 5 p.m. they saw Failor stop at the two-way stop sign on C.R. 15 and then drive into the path of an oncoming SUV, which had the right-of-way.

Joseph Martin, 34, from South Bend, told police he saw Failor pull in front of him, but didn't have enough time to stop.

Martin was transported to Elkhart General Hospital with pain in his chest and knee. Failor was pronounced dead at the scene.

Police caution drivers even when you have the right away at an intersection you should still keep an eye out for other hazards.

“If you're coming up to a two-way stop and you have the right-of-way you always have to plan on the possibility somebody may not stop or may be in a little bit of a hurry and stop and try to quickly go in front of you, so at every intersection there's a danger," said Capt. Michael Culp with the Elkhart County Sheriff's Dept.

Both drivers were wearing seat belts, but Culp told NewsCenter 16 it is not always able to help a driver when their vehicle is hit directly on its side at a high speed.
