Today brought an interesting twist in the domestic violence case filed against former Notre Dame football player and assistant coach Mike Haywood.
The alleged victim in the case today said that she never wanted to see Haywood arrested or prosecuted.
The statement came in court with the alleged victim under oath.
The woman didn’t sound much like a victim as she indicated she wasn’t afraid of Haywood and that she believed Haywood posed no danger to her.
In fact, the same woman who placed the New Year’s Eve 911 call that resulted in Haywood’s arrest, today testified for the elimination of a court order barring contact between the two.
“The victim did appear in court today and made a statement to the judge under oath,” said St. Joseph County Deputy Prosecutor Christy Haws. “The state objected to having the no contact order terminated but in spite of that objection the court did vacate the no contact order.”
The move means that “there are no restrictions between the two of them having contact with each other as far as the criminal case is concerned,” Haws said.
That means both the woman and Haywood be at the scene of the alleged crime (the Haywood home in St. Joseph County) at the same time—for the first time since the incident.
During court proceedings today the woman indicated that her only interest in re-establishing contact with Haywood was to discuss matters related to raising the couple’s young son.
At one point she indicated that she wouldn’t necessarily want contact with Haywood if it weren’t for the child.
As Haywood left the courthouse today the case against him didn’t seem as strong as it was when he walked in.
Nonetheless, his legal troubles appear far from over.
“The state is still in a position where it can proceed with the case, it’s not anything that requires a dismissal or requires something to happen other than us just continuing to go forward,” said Haws. The dates (in court) that were set earlier this week remain in place. So we will continue to proceed with the case and let it take its course as we go forward preparing for trial or plea negotiations, those types of things that normally happen with every type of case that we handle.”
Statements made in court indicate that the woman and Haywood have an ongoing case in probate court regarding custody of the child and that the woman reported the New Year’s Eve incident because she thought Haywood’s behavior had escalated to a point where something should be done.
The woman claims she told police officers who arrived at the Haywood home on December 31st that she didn’t want to see Haywood arrested or prosecuted.
