The Elkhart teen charged with torturing a dog after throwing a firework in her mouth is back in court.
Marquis Gary, 16, faces a felony animal cruelty charge.
On Friday, a judge listened to both sides during an evidentiary hearing. By Monday, she will make the decision on whether or not Gary should be waived to adult court.
Prosecutors also filed armed robbery charges against him.
Gary’s grandmother says he was not the only teen throwing fireworks at the puppy, and she questions why he is the only one being charged.
