Special Prosecutor assigned to Elkhart Co Commissioner Terry Rodino case declines prosecution

A pending case against an Elkhart County Commissioner has been dropped.

The Allen County Prosecutor’s Office received a case against Elkhart County Commissioner Terry Rodino. The office agreed to serve as Special Prosecutor in the investigation after the Elkhart Police Department made the initial report.

Initially the report indicated a woman was allegedly sexually assaulted by Rodino. During the investigation it was determined that the alleged victim and Rodino did have a prior sexual relationship.

However, according to a press release from the prosecutor’s office, “We do not believe we can prove forcible sexual assault beyond a reasonable doubt. Therefore, prosecution of this case is declined.”

According to our reporting partners at the Elkhart Truth recent court filings by business foes say he sexually assaulted a woman with whom he had a business relationship. It allegedly happened on October 29th somewhere on company property.
