ST. JOSEPH A former nurse at the Lakeland Regional Medical Center in St. Joseph won’t serve any prison time. A federal appeals court threw out his conviction for sexual assault.

David Lall was tried twice in Berrien County Court for a 2004 incident. He was convicted in 2006 and sentenced to up to 9 years in prison.

Lall was accused of drugging a woman with valium, then assaulting her. He appealed the conviction, and a federal appeals court threw it out.

The Herald Palladium reports that the prosecutor does not plan to appeal this most recent decision.
