ST. JOSEPH COUNTY, Ind. A South Bend Common Council member, who posted an explicit photo on Facebook, is now being investigated by the Indiana State Police.

The St. Joseph County Prosecutor's Office announced Wednesday afternoon that it has filed a petition asking for a special prosecutor to investigate complaints against Henry Davis, Jr..

Earlier this month, we learned that nine complaints were filed against Davis, Jr. because of an explicit photo he posted on Facebook involving a naked man and his dog.

Davis removed the image and publicly apologized.

Last week, members of the council's rules committee handed the investigation over to the council's attorney to look into whether there was any wrongdoing.

Daniel Hampton, prosecutor for Kosciusko County has been appointed to the case, and he'll determine if Davis should face charges.
