With the construction season upon us, road closings seem to be a way of life. One Michiana neighborhood has gone to court to keep traffic flowing.
Residents of Creston Hills in Mishawaka have filed a lawsuit over the Capital Avenue construction project. The construction crew plans are to shut down two of the three roads that service the subdivision. The suit contends that the closings would violate the fire code, by shutting down the only road into the neighborhood that is at least 20 feet wide.
Thursday, the parties filed a stipulation in court that addresses the residents concerns. Indiana's Department of Transportation agreed not to close Hill Street for the time being, and to build a new road out of the subdivision that would connect to Elm Road.
