Mishawaka excavating company fined after man hit, killed by tree

MISHAWAKA, Ind. A Mishawaka excavating company has been fined by IOSHA after a man was hit by a tree, and killed.

Mark Ellsworth died from blunt force trauma to the chest and neck. He was working with R and R Excavating near the intersection of Bulla and Twyckenham Drive on the campus of the University of Notre Dame in November 2013.

IOSHA has issued several serious violations to R and R Excavating and a fine of $17,500. The violations include not providing the proper leg protection, not using hand signals or whistles when noise or visibility is a problem, and not having employees two tree lengths away from the tree being felled.
