Terry Wayne Waugh Jr., 30, was sentenced Wednesday to 50 years for Child Molesting, a Class A Felony, and eight years each for two separate counts of Child Molesting, each a Class C Felony.
The counts will run consecutively for a total of 66 years.
The Court also declared Waugh to be a Sexually Violent Predator.
Waugh was charged for molesting a child (referred to as B.D.) over a period from June 1, 2003, to May 11, 2005.
B.D., during this time period, was between nine and eleven years old. Waugh was the brother of B.D.'s mother's boyfriend.
A bench warrant was ordered issued by the Court on January 5, 2007, when Waugh failed to appear for a hearing.
Waugh was arrested November 16, 2013, by Indiana State Police and the U.S. Marshal Service in Steuben County, Indiana. He was transported back to St. Joseph County to stand trial.
On July 24, 2014, a jury found Waugh guilty of one count of Child Molesting, a Class A Felony, and 2 counts of Child Molesting, each a Class C Felony.
The jury issued a verdict of "Not Guilty" on Count IV, Child Molesting, a Class 8 Felony, and the Court entered a judgment of acquittal on this count.
During the two years (June 2003 to May 2005) that Waugh molested B.D., Waugh turned 21 years old. Count IV was charged as deviate sexual conduct committed by a person at least eighteen years of age but less than 21 years of age on a child less than fourteen years of age. Count III was charged as deviate sexual conduct committed by a person at least 21 years of age on a child less than 14 years of age.
Thus, Count III and IV encompassed the same acts. However, Waugh was charged as being of different ages at the time the acts were committed.
