Indiana State Police Officers found liable in the blue jeans bar incident in 2010

Mishawaka, Ind. Two Indiana State Excise Police Officers are liable for damages for seizing evidence without a warrant.

The case dates back to 2010, and involves the seizure of the video security system at the former blue jeans bar in Mishawaka.

The officers acted on a tip that the video would show Shawn Devine drinking in the bar, shortly before he was involved in a drunk driving accident that killed Mishawaka Police Officer James Szuba and his canine partner. The claims were never substantiated, but the bar later lost its liquor license.

A federal judge ruled that Excise Officers Tim Cleveland and Kayla Dawson were liable in the case, but dismissed claims that the officer's actions were racially motivated. The next step calls for the court to schedule a settlement conference.
