Group is suing city of Elkhart and Mayor Moore

Elkhart, Ind. A group of unhappy Elkhart County residents are ready to file suit against the city of Elkhart and it's mayor.

"Elkhart Citizens for Fair Sewer Rates" say they'll give the city one last chance to address the sewer issues before asking for a jury trial.

Last week, Mayor Dick Moore threatened to disconnect the few remaining households which haven't signed the existing sewer compact.

But, "Citizens for Fair Sewer Rates" said it’s willing to go to court if that happens.

Newscenter 16 obtained a draft of the complaint, which calls the surcharges, illegal, unreasonable and unjust.

They're giving the city a two-week time frame to work things out, before taking formal legal action.
