Gingerich to get new judge during new hearing

The judge who sent a 12-year-old boy to adult court where he pleaded guilty to murder, will not be part of a hearing to determine if he should be tried as a juvenile.

Paul Gingerich's attorney has requested a new judge. Whitley County Judge James Heuer will now handle the case.

Gingerich is 15 and in juvenile prison for helping a friend kill his stepfather in 2010. The Indiana Court of Appeals threw out his guilty plea and sentence in December, and ordered the new hearing.

The court said the Kosciusko County Judge rushed when he waived the case to adult court. Attorneys for Gingerich argue that he did not understand the legal process or plea bargain.
