Elkhart County prosecutor rules in favor of officers in Labor Day shooting

The Elkhart County prosecutor says three officers acted appropriately when they shot and killed a man during an attempted break-in over Labor Day weekend.

The officers involved in the shooting were Cpl. Bruce Anglemyer, Cpl. James Ballard and Sgt. Karl Miller. They will not have to face a grand jury after the prosecutor’s findings were released on Monday.

Back on Sept. 1, Jamie Benavidez, 27, died of several gunshot wounds after trying to flee the scene of an attempted burglary.

Indiana State Police had conducted an investigation then submitted all the information to the prosecutor for review.

The prosecutor has ruled that the officers’ actions were a reasonable use of force, and that Benavidez threatened the safety and security of the community.
