Family of Elkhart County man who died of fungal meningitis wants answers

The family of an Elkhart County man who died from complications of fungal meningitis wants answers.

Goshen attorney Richard Crowder filed a lawsuit on behalf of Daniel Rohrer's family in Elkhart County Superior Court No. 1 on Oct. 30.

In October, Rohrer was treated at Elkhart General Hospital after receiving a tainted steroid shot, which resulted in the illness.

"At that point, there were a lot of prayers and thoughts going out to him that he would survive this," said Crowder.

But, on Oct. 23, Rohrer lost his battle with fungal meningitis, making him the 25th person in the nation to die as a result of the illness.

"Here you have people that were suffering from chronic pain conditions and the very treatment that was supposed to help them have less pain and have a better quality of life we believe caused them to pass away," Crowder said.

While Rohrer's family wants to grieve privately, they also want the people responsible to be held accountable.

Their wrongful death suit seeks damages from the New England Compounding Pharmacy, Inc. and all of its subsidiaries.

"The family, they want answers," Crowder said. "They want to know why, they want to know how this type of thing can happen."

Crowder said he believes the wrongful death suit is the first in Indiana related to the fungal meningitis outbreak.

He says as the number of people affected continues to grow, the number of complaints against NECC will likely increase.

That means the Rohrer family's case could end up in multi-district litigation, or even become a class-action lawsuit.

While the legal battle will likely take time, Crowder says it will be nothing compared to the time Rohrer's family will spend grieving.

"They're not having their father, Diana is not having her husband there anymore," he said. "They ran a lawn care business together for years and years. He's her life companion."
