Man charged in a double shooting appears in court

A man charged in a double shooting in Benton Harbor was in court Thursday.

Javon Davis, 28, of Benton Harbor, is facing multiple charges in connection with the alleged murder of Gary Alilovich, 25, of Niles and the injuries of his former girlfriend, Heather Poe, 35, of Benton Harbor. Davis’s sister, Ashley, is also facing charges, but will appear with a separate attorney at a later date.

Davis was in front of Judge Gary Bruce at Berrien County Circuit Court Thursday afternoon.

During a two and a half hour preliminary hearing, the prosecution called 6 witnesses to the stand, including Poe, her 10-year-old son, and her friend and a witness at the scene, Crystal McKenzie.

By the end, Judge Bruce still wasn’t convinced, so his decision is postponed. The prosecution has until February 14th to file a brief, which will be followed by a brief from the defense on the 22nd. Judge Bruce said he’ll make a final ruling on whether to move to trial, and continue with a first degree murder charge then.

The prosecution is sticking firm with the first degree murder charge, which carries a life sentence and no chance of parole.
