Council's legal right to punish Henry Davis Jr. called into question

The South Bend Common Council, on Monday, is scheduled to consider possible punishment for one of its own for a controversial Facebook post.

But a challenge filed Thursday contends that the council has no legal basis to do so.

When considered at the committee level last week, council members split on a proposed censure for council member Henry Davis Jr. by a vote of two to two.

Davis contends that a majority vote in committee is needed for the matter to move before the full council.
