Neighbors say the recent shooting at the Wooden Indian is proof that the place needs to be shut down.
Police have been called out to the motel 109 times in the past year.
People who live around the Wooden Indian are very outspoken about the need to close the motel.
They say they see drug deals, fights, and shootings all hours of the day.
The city attorney said the city can’t close the motel basically because the owner is in compliance with city ordinances.
It's the guests who usually break the law.
“Well they need to go in and clean it up that for one thing I mean not all motels are like this they need to straighten up the situation,” says neighbor Star Jeziorski.
“We have a situation where we don't have current tools to take any type of drastic step to close it down or restricting the way it operates at this time,” says South Bend city attorney Chuck Leone.
The city attorney says in February the Wooden Indian passed the building and fire inspections.
For the past 2 years the Wooden Indian has not been listed as one of the city's "problem properties."
