Charges will not be filed against an Elkhart Police Officer involved in a deadly January shooting.
Patrolman Mike Davis shot and killed 31-year-old Gerald Cooley, after police responded to a domestic disturbance on West Jefferson.
A Grand Jury was sworn-in on Tuesday to review the case and came back with their decision Thursday morning.
Officer Davis has been on paid leave which is standard procedure, during an investigation.
A lawyer for Cooley's family says they are disappointed, but not surprised, by the Grand Jury decision.
He says the family is filing a wrongful death suit against Davis.
