Roseland Town Councilman David Snyder faces years in jail, if he's convicted of the charges filed against him today.
Snyder is accused of Felony Intimidation for last week's fight with fellow councilman, Ted Penn. That carries a penalty of 6 months - 3 years in jail. Snyder was also charged with Battery, a Misdemeanor that could land him in jail for another year.
Ted Penn would only reveal a few scratches on camera. Off camera he showed Newscenter 16 a bruise the size of a softball on his upper thigh.
“I was probably kicked for 10 or 15 minutes,” claims Penn. “His (David’s) Dad entered the fray. His dad was primarily working on my groin area. I'll show your camera man some of the bruises.”
Penn says more than 50 police photographs documenting his injuries will come out in court.
Even more disturbing, what Snyder reportedly said while he was beating Penn, “he finally got down close enough to me,” Penn recalls, “and Snyder says, ‘I'm going to kill you. I'm going to kill you. If you say anything about this, I'm going to kill you.”
Penn believes David's father, the Reverend Russell Snyder, will eventually be charged for his part in the attack and that former Council President, Dorothy Snyder, stood by and watched her husband and father-in-law beat Penn.
“Dorothy Snyder tried to intervene with her husband,” Penn explains. “She grabbed his arm and he twice smacked her and hit her, and put her up to and almost over the partition. She said ‘David, David don't do that!’ and I can't identify what it is because it's not in your report. I can't go beyond that.”
Penn goes on to say, “I was finally able to get my cell phone and the very first person on it is Mike Schalk. I said, ‘Mike get here because they're trying to kill me!’ They locked him out. I saw Dorothy Snyder lock the door, that's criminal confinement.”
Newscenter 16 spoke with Dorothy Snyder tonight she said, “it seems very bizarre that Mr. Snyder is being treated differently by the prosecutor's office."
"Injustice is a terrible thing to see and experience. You would think in this country that everyone would be treated the same."
"Mr. Snyder is still a council member and will perform his duties."
David Snyder has been advised by his attorney to turn himself into the jail, likely tomorrow. Dorothy says she will post his bond.
