From our reporting partners at the Truth, the case against the 16-year-old boy, involved in the death of 11-year-old Aaliyah Joiner, will stay in juvenile court.
That is according to the Elkhart County prosecutor.
Police say the 16-year-old had the gun at Memorial High School the day Joiner was shot.
The boy has not been formally charged.
He faces a preliminary charge of possession of a handgun on school property.
Tuesday, the 12-year-old cousin of Joiner was formally charged with reckless homicide.
According to court documents, the boy pointed the gun at Joiner and pulled the trigger, but said he did not know the gun was loaded.
