South Bend police say Roseland Town Marshal Craig Toner was killed in a hit-and-run accident Saturday afternoon in South Bend.

It happened around 4 p.m. at the intersection of Ironwood and Rockne.

Police say Toner was off-duty, and riding his motorcycle with his brother, northbound on Ironwood, when a driver heading southbound in an SUV crossed the centerline and struck Toner’s motorcycle. Toner landed on the vehicle’s hood.

The SUV’s driver -- Alexander Orta, 26, of South Bend – stopped his vehicle and Toner slid onto the ground. Orta got out of his SUV, surveyed the scene, and then got back into his vehicle. He subsequently ran over Toner and crashed a half mile from the initial impact.

Toner was pronounced dead at Memorial Hospital.

The St Joseph County Fatal Alcohol Crash Team (FACT) was dispatched to investigate the crash. They secured a forensic blood draw and results are pending.

Orta was arrested for two class C felonies – Operating While Intoxicated Causing Death, and Leaving the Scene of a Fatal Crash. Jail records show that Orta has been arrested 19 times since 2000.

Toner, who loved to ride, was recently promoted as Town Marshal for Roseland police after 3 years. Before that he served as a Captain for Mishawaka Police for almost 20 years.

Toner is survived by a son and daughter.

Friends and family gathered Saturday night to mourn the loss at Moondog’s on the south side of South Bend, the place that Toner liked to go and unwind.
“Craig’s the kind of guy who would go out of his way to help people,” said Mark Lewandowski, one of Toner’s friends. “When I was a rookie and he was a Captain, if he would see me struggling with something, he would just walk up and say hey, let me help you out, show you what to do.”

Many will simply remember him as an all around great guy. “A happy guy,” said Lewandowski.

I started my law enforcement carrier a while ago. I have never met "Alex". My personal opinion is that, he made a bad choice. He then made another choice...TO KILL. I can't say "ALEX" is(nor is his family) bad. But I can say (on a blog) that this is %%EVIL%%. no death penalty just let him think. I Lost one of my best friends and my mentor.

To Lil Mex: Do you really think Orta, or you for that matter, are the type of people President Obama would defend? I would venture to say no. Perhaps the only "currupt" person in this tragedy is Mr. Orta. (By-the-way "currupt" is actually spelled corrupt.) It is absolutely appalling to blame the witnesses for not stopping your buddy. Do you also blame the bar for serving the alcohol, the dealer for giving a "good guy" the coke, and the car dealership for selling the car that was used when Orta chose to run over this good citizen? At what point is it the perp's fault? People can still support Orta without supporting his heinous act. The sooner people start taking responsibility for their actions, and stop blaming everybody and everything else, the better society will be. God's blessings on both families.

i have known alex for almost five years. there is no excuse for what he did and he does deserve the death penalty his 8 year old is better off without him. it's like he never had a father to begin with he has always been in and out of jail. if you ask me, he is not being charged with nearly enough. coked up or not, he should have made better decisions, not only that night but throughout his life. he deserves the death penalty. his entire family has always told him to straighten out his life for the sake of his child and he never did. at least he has a good mother. if this is what it takes to get him to realize that his entire life has been a waste then so be it. i am a friend but i do not defend anything he has done or any of the decisions he has made. to get out of the vehicle and look at the man and then procede to run him over was cold hearted. and you cannot use the race card, i'm latino too but God gave me a heart!

I have known Alex for over a year now. I never was able to figure out why he made the descions he made. He chose to be friends with the wrong people even worse half of them are family. I am disappointed in Alex I have always told him, keep choosing the path your on you will end up dead or in jail. Guess I can say I told you so. I never knew it would come down to him taking a life. I will tell you this everyone makes mistakes and bad decisions. Alex came from a loving immediate family with whom I have the utmost respect for, this is Alex's problem so leave his family out of it. They have the right to support him in anything they choose. Alex is amazing with kids polite in public, and giving to his family friends. He wanted to change become a better person in society, honestly people,he did, he just couldn't handle the slow boring life of responsibilities and hard times. Now he is going to learn what hard time is. Alex did not kill Officer Craig on purpose! He was scared!

To the posters that are saying no to murder. Well Toner was injured after the first impact, he was killed on the second. The first might have been a "mistake" if that is what you want to call it. The second impact was intentional and the vehicle was the weapon. that makes it murder. If you dont like all the shootings then quit defending the thugs, it seems like the same crowd says lock up everybody but then this happens and you jump on the side of the suspect. Pick a side then stay on it.

It does not matter to me that the victim was a police officer or that the suspect is hispanic. What matters is that Mr. Orta chose to drive intoxicated and hit a PERSON. He then looked over the scene, got back into his car and drove over this man. That is what killed Craig Toner. What kind of "person" would do that? I hope that Mr. Orta receives a life sentence for the Murder, so I do not have to worry about him hurting anyone else. And yes, I feel bad for both families. I could not imagine if my "bum" relative killed someone so ruthlessly. I would be appalled and embarressed, and certainly would not know what to say to the victim's family. How can you explain his actions? I wish strength and comfort to everyone involved in this tragic incident. Mr. Orta, please stay in jail where you cannot hurt anyone else.

I met Craig one night in November 2007 when he was working security at St Hedwig's. I struck up a conversation with him and ID'd myself as being a former Deputy Marshal. Craig's face broke into a smile and he patted me on my back, shook my hand and said, "Let's go inside where it's warm and get a cup of coffee." I spent a wonderful 30 minutes chatting with Craig and felt once again that instant bond that exists between LEOs. Craig treated me like a long-lost friend and even though I had never before met him, he made me feel as if he had known me all his life. We talked about past experiences, motorcycles, and life in general. At the end of those 30 minutes I felt as though I had known Craig all my life, too. He was an honest, genuinely good person who had a left a wonderful impression on me. As he returned to his duty, I told him that if he were to have any problems outside to yell, and I'd have his back. And I meant it, and he knew I meant it. God bless you, Craig. I salute you.

Interesting that all of those people defending Orta can not even spell simple words or write a simple sentence. Their comments just demonstrate how those people that are continuously exposed to alcohol and drug abuse and frequent run-ins with the law just don't think it is a big deal...just a "mistake". They also assume that since that is THEIR normal lifestyle, everyone does it. These types of lifestyles have contributed to the deterioration of society's values all around. It wasn't a drunk, "rich", ND Alumni driving and it wasn't a drunk law enforcement officer. It was your friend and relative and he should be responsible for his actions. Quit making excuses. I live far above your inferior standards and values and am proud of it. It's one thing to ruin your own life, but when your abuse problems take away the life of an innocent victim, you deserve to be punished as the CRIMINAL you are.

I have been a dispatcher for the past 15 years and had the pleasure of working with Craig. He was caring, considerate and very street smart. I will miss his boyish grin and smirk he would get on his face. I feel he is up in heaven at this moment along with Bryan, Tom and Tim looking down on us and laughing. His sense of humor along with his caring nature is what made him Craig. I will miss you and know you will be taking care of all of us. My prayers go out to your family, friends and fellow officers. Not even death is a good enough punishment in this case. Yes everyone makes mistakes but this is way to extreme of a case to say he deserves "another chance" He drove drunk and had an accident, That alone may be understandable although a bad choice. But then to not check on the person you hit, who could of still been alive at that point, and then run them over? That is just mind boggling and sick. I would say at that point "the accident" becomes murder. I hope he gets everything he deserves. His race does not matter nor does his record i would feel the same about anyone who did this crime, you want to call people racist? you need your head checked. and then even worse you say that god wanted it to be this way? Hey "Lil-Mex" First off- your thug buddy Orta hit this Officer during day light hours, he should have seen and heard the Officer who landed on his SUV for christ sake. Orta gets out of his vehicle obviously something effected his brain cells cause then the thug gets back in his vehicle and runs the Officer over, which probably killed the Officer. Bottom line - Once a Thug Always a Thug! Judges give him the death penalty!

The difference is, this idiot got out, looked at the carnage and decided to drive away, in the process killing Toner. This ceased being a drunk driving ACCIDENT when Orta MADE THE CHOICE to run over Toner. This was much more than a mistake..if you can't see that, then you are an idiot too.

I don't see where people are getting that this is any sort of "race issue." The facts are that one human being made several bad choices and as a result another human being is dead. It amazes me that our justice system allows this sick individual to be arrested 19 times(that alone should be a red flag)and did nothing knowing he would end up killing someone else or himself. Since he killed a police officer and left the scene he will be put in prison where he belongs; hopefully? It always takes something this tragic to open people's eyes; WHY!! People make mistakes and on 11/1 Alex make a mistake and I know for a fact that he was not in his right state of mind and he wouldnt have ran over the officer. Why was'nt he wearing a Helmet huh?? i dont want to get caught up in this fueding, but I am sick and tired of people saying, "it could have been anyone drunk driving". At the end of the day it wasnt anyone, it was this guy Orta. Stop with the what if's or what could of's. Because none of those things happened. we have to deal with what did. A great man that loved to do nothing but help people was taken away from us by the irresponsible, and i'm sorry but unforgiveable, actions of a person who has spent about a third of his life making the wrong decision which has landed him in jail 19 times. And to say people are being racist? It has nothing to do with Orta being hispanic. When I was told what had happened by friends, no one said that a hispanic man had done anything, all that was said is that our friend was hurt by a drunk driver. There was no race card being pulled. Maybe it's time for Indiana to make helmets mandatory for motorcycle riders. Aside from Mr. Toner I know 4 others who died on a bike with no helmet. Race is not the issue here at all!! Have any of you ever been drinking and driving hit someone, and kill them? I doubt it!!! He is 26 years old which in this day, and age is really 16!! Put yourself in his shoes!! He is sober now, and knows the rest of his life is probably over!! For the jail deputy you should think before you speak moron!!! Your comments show and prove why people can't stand police officers!! When I was a kid cops use to know all the kids in the neighborhood by name, and they gave a sh** about us and the community. Hey Pam that could have been anyone drunk driving, it just happened to be someone with a record!! There were 80,000 people tailgating, and drinking like Alex was. It could have been some rich N.D alum that hit him, then we wouldn't be discussing this!! I have four children, and I hate drunk drivers but don't attack someones previous record for a terrible mistake they just made!! We have all saw, and read the news before when Debra Daniel was drunk driving, and hit, and run. Or how about when SBPD captain hit a tree on Ewing St Drunk Driving. All I am saying is he is not the first person driving intoxicated! The kid is 26 years old do you think when he left tailgaiting he thought he was going to kill someone?!! I doubt it. God lets things happen for a reason. I Alex know what he did was wrong. If it was the other way around no one would be saying stuff like this. If his alchol level was that high how could he know what was going on. Alcohol makes some people loose there state of mind. I know this person well and I know if he had new that the officer was infront of the car he would'nt have ran him over. All people want to do is make the person bad. We are all human. God does not like ugly. We wonder why are world will never be a good one. People make mistakes thats a part of life and I know that does'nt condon what he did. I know he is just as sorry and wish'es he can take back that day but the damage is done. Mr. Orta also left behind a son who is 8 yrs. old. Who is so torn by this. Who does not understand how to understand this situation. I give my condolences to the Toner Family. I dont know what else to say that can make things better, but I know I can't. We need to try to make this better for everyon.

He killed before, he had a second chance and obviously is too stupid to go straight. He knew how to work the system, and our worthless appointed Judges in St. Joe county let him go every time. Until the people of this county and Lake county wake up and get these overpaid idiots out of our court system, this will continue to happen. The police can arrest them and the prosecutor press charges, it is the Judge's that let them go with a slap on the wrist and a stern warning not to do it again. Thank you Craig for all the excellent police work you did in your lifetime. It was a privilege to have known and worked with you. I pray that your suffering was short and that God will bring comfort to all who are grieving your passing. It was always a pleasure to assist you. Even your voice had a smile. You are greatly missed and sadly mourned by all that knew you. I am still having trouble understanding how any human being can run another over in the street like an animal after getting out and looking into their face. What kind of a man does such a thing? Please God bring justice to this horribly wrong situation. For those that are taking the comments personally, let them understand that anger is part of the grieving process, and the grieved have a right to express themselves. Only God knows if this was murder or an accident and may he bring swift justice. God Bless you, Craig. May we meet again in Heaven, for that is surely where you are. You will never be forgotten.

Craig was an exceptional man and police officer. Not one time did I ever hear anything negative come out of his mouth. What disgusts me is the brutality of this crime, and the fact that a 'friend' of Orta's is on here defending him. I can guarantee any LEO on here can verify fact that Orta has a record a mile long. And NOT for 'minor things', as 'Alex's Friend' stated on 11-2-08 at 3:59 pm. Of course, it would depend on what one would consider 'minor', I guess. If he felt bad, had morals, or had been rehabilitated for his past mistakes, as 'Friend' states, he would've gotten out of the SUV and made an attempt to help Craig instead of making things worse. I'll bet Orta is hoping he stays locked up for a long time. He stands no chance on the streets now. ~Rest In Peace Craig~

As far as Orta's arrest record it clearly shows that 19 arrests and no convictions means that the police and prosecuters are doing a horrible job and that the judges are doing theirs.

I agree with mike, this "friend" calls people by racist names and wonders why people think things about each other. I am not looking at his skin, I am looking at the FACT that he has been arrested 19 times, once for a fatal crash. If he has a problem with his drinking, he should stop. Apperently, he wasn't taught or didn't listen when his parents or teachers talked to him about drunk driving when he was in school. It is time our elected officials start doing their jobs and get these people in jail where they should be. If that was the case Mr. Orta would not have done this.

On Saturday afternoon I was taking my grandaughter to do some shopping and I think we saw Officer Toner on his Harley when we were driving down McKinley(20) about an hour and a half or so before he was hit. As we pulled up to a light my grandaughter pointed and said to me gramma, thats a Harley and my daddy has a Harley. I said to her,thats right honey he does. At that moment the man looked over to my grandaughter and gave her the biggest smile and wave to her delight! I continued on when the light changed and we lost sight of him. We did our shopping and were on our way to the fire station my son is at so she could see her daddy and on ironwood we had to go around where this happened, I knew when I saw the bike that it was the one that was carrying the man that so kindly took the time to give a little girl a big smile and wave.May God Bless this man and his family, he had such a kind face and smile.I think in death he still protected others from the same fate.

It really saddens me that race and ethnicity has anything to do with this. Two families are affected by a TRAGEDY! Tragedies happen and are irrespective of race, gender, ethnicity, social status. Please, let's not degrade the memory and accomplishments of Officer Toner by attacking Mr. Orta. Mr. Orta made a mistake and unfortunately Officer Toner lost his life. The pain of the tragedy cuts both ways. Both families face losses.

Arrested 19 times in 8 years and only 26. Surveyed the scene and promptly ran over the officer to assure his death. This guy needs his life revoked...And anyone wishing to defend this scum needs to seriously consider Madison Center's mental health clinic for further evaluation.

It never ceases to amaze me that people condone the behavior of people like Alex Orta and then those people turn around and dare to ask WHY or act all suprised when something happens. Aw gee, I know he drinks and drives but I didn't think he'd kill anyone.. Again.. I've met Alex Orta and quite honestly, it shocks and amazes me that people can stand to be around him and claim him as a friend. The Alex Orta that I know has a substance abuse problem and he's a little A-Hole even when he is sober. Alex is a waste of space and it's a shame that a guy like Craig Toner had to die at the hands of a man who has never been, and never will be good enough to tread the same footpath.

I worked with Craig on many occasions while driving tow trucks in Mishawaka. He was always a class act and always had a kind word to way when your were down. He will be truly missed my the Michiana community. My thoughts and prayers go out to his family and friends. I will surely miss him.

My children and i witnessed this CRIME, we will never forget what we saw that day. Anyone posting a comment defending Alex I cannot understan, i have sympathy him. This is not something anyone is capable of doing. I do not drive drunk. He drove over him to get away thinking only of himself. Horrable unthinkable I was in disbelief that a human could do that. Alex showed his character on Sat. He should be locked up for life. To the family of Criq I send my prayers and hope you find the strengh to get through this unspeakable act of ignorance. We will be left with the memory of what we saw that saturday afternoon forever. My three and four year old children are pledge now with viewing Alex's horrible actions.

I want to send my sympathies to the Toner Family, I can only imagine what you are going through. To Alex's Family my sympathies also go out to you because you have to ashamed for what he did. I mostly feel bad for his son because he doesn't have much to look up too. Alex has to realize that not only did Mr. Toner have to pay the ultimate price for his mistake everyone else does also. It is a continuest cycle. I think that everyone should keep there racist thoughts to themselves its hard to believe that in 2008 and the fact that we could have a black president that racial profiling still occurs. Fortunately this could of happend to anyone at any given time, you go by the liquor store and at 7am there are patrons there. Alex's prior arrest shouldn't dictate his future or his son's. I totally understand your pain. My uncle Bill had his brain blown out of his head from a drunk 16 year old boy who was drunk. He ruined my whole family's life as well for a long period a time, but people do not have the right to say that there should mobs sent out, or that his family should die!! I meant Craig aka Dutch for the first time last weekend. I didnt know that my first time meeting this exceptional man would be my last. He brought so much joy to my friends and family. He's also pushed one of my best friends into being a new but amazing cop. His memory will live on in my family's hearts forever. I hope that Orta gets the max punishment for taking this wonderfull man away from his and my family and friends.

Dear Edward, I am his friend! I have been for a very long time. I grew up knowing him from the neighborhood. I wouldn't call myself a scum bag. You shouldn't either. you don't know me, I could be the very person working on you if you get hurt! The point is, you never know who, what, when or where, but bad things happen to people, and I'm so sorry it was Alex that has done so. I also knew Alex personally and yes he would hurt somebody intentionally. He was a piece of trash and I won't be surprised when they confirm not only alcohol in his system but some drugs as well. I take exception with "T-bird" blaming the victim, Craig Toner, for his death. Orta had a choice to drink or to drive. He chose to do both and an exceptional human being, a good person, died. I have no sympathy to spare for Orta -- who is obviously a drunk and a coward. He drove over the man to make sure he was dead! I do extend my sincere sympathies to the Toner family. I had the privilidge to work with this man. It was a short time in which I am greatful for. I was a young officer that Craig befriended and gave lots of great advice. I have so much respect for Craig. It is with tears that I write this as I think of the great guy that Craig is. My prayers go out to Craig and his family. Thank you for everything Craig.

I am so sorry to hear of this man's untimely death. I am troubled that the drunk driver was arrested "19" TIMES! Who didn't do their job? Why was the idiot on the streets? I will gladly pull the lever to eliminate this trash from our society. Ok, so the policeman was killed by a drunk driver and everyone gathers at Moondogs Pub to mourn? What kind of message are you sending? How many mourners had drinks and drove home? Tell the truth and don't make excuses.

It's not the criminals you should fear in St. Joe County, YOU SHOULD FEAR THE JUDGES OF ST. JOE COUNTY!! This guy should have been in jail and not on the streets getting drunk and having a good time! Craig was a great guy. I worked with him on calls and he was a fantastic police officer and a severe loss for the community.

Another tragic crime committed by a known felon. He was charged before for leaving the scene of a fatality accident, so how many chances do these low life's get. If arrested 19 times since 2000, sounds like the typical work of our St. Joe County Judges. Wake up St. Joe County , our legal system has a revolving door, how many more inocent and decent people have to be killed, while the carreer criminals roam free to do it all over again. This dirt bag better get charges that stick and make him do hard time. He's killed two already, what does it take to go to jail here? God speed Craig, you were a gift to this community, and a great person, you will truly be missed by those who know and love you.

I hope they throw that guy in jail for the rest of his life. When will the courts get smart. How can someone be arrested 19 times, once for another leaving the scene of another fatality accident, and still be out on the road, being a danger to others. Here he is killing an innocent person because of his stupid choice to drink and drive. I truly hope to hear that his is going to jail, for life, with NO chance for parole.

I want to offer my sincerest condolences to the family of Officer Toner. I experienced firsthand his kindness and decency, just as others have decribed. He assisted me in a hit and run involving another vehicle leaving the scene after hitting mine. And I have nothing but the greatest respect for Officer Toner after that incident. After the accident, I told my wife and so many others 'what a great guy, really nice guy, Officer Toner is!' I felt this after only one encounter with him...but when someone is such a wonderful, caring, and decent human being...it only takes one impression to know it. That's all it took for me. One simple traffic accident to experience the greatness of this kind man, Officer Toner. Thank you, to his family for sharing him with this community, and for his service here...making it a better community for every one of us whose paths he crossed. May God Bless him. Our prayers are with you.

Craig had no known enemies! He was there for anyone who needed him. My prayers go out to his family, both police departments he served on and the town of Roseland. He was a dear sweet man and they just don't make them any better than Craig. Rest in peace Craig, you will be and are missed!

This alleged drunk was arrested 19 times in less than 9 years? This is another tragedy that could have been avoided if some decent jail time waqs handed out on say the tenth "second chance". My heart goes out to this poor guy and his family...very sad.

Godspeed Craig. A man dedicates his career to taking scum off the street and a POS like this leaves the scene while driving under the influence and kills a police officer who is off and enjoying life like Joe Citizen. Unreal. Hopefully a charge more than causing death while intoxicated can be had.

Mt. Toner was my sister-in-laws father. He has a 3yr old granddaughter. We were all together last night for trick or treating. His family is devasted at the loss. He had just purchased a home in South Bend and was looking forward to maoving and being closer to his daughter and granddaughter.

This is very sad as Craig was a very nice person as well as a nice officer. I have known Craig for years and this a tremendous lost to all that knew him as well as his family & the community. I am so sick of hearing about drunk drivers killing people & taking away good people only for the drunk driver too do a year in jail and back out on the streets driving & enjoying time with there family...WHEN IS ST JOSEPH COUNTY going to say no more Pleas & start throwing the book at these individuals??? Craig you will always be in our hearts & I'm saddened by this.

I was at the hospital ER with my ill mother when he came in. They worked on him for over three hours. What a shame.They went above and beyond to save him. My prayers to the family.

That is down the street from our home. People drive way to fast through the neighborhood cutting through to the main roads. People need to slow down so that tradgies like this do not happen again.

He gets back into the SUV and then runs over him again? The Lord might have mercy on this persons soul, but the court should not. Sounds like they forgot one important charge...Murder. He got back in the vehicle, knowing full well that the Marshall was right there and ran over him again. Anyone think this other than myself? My heart goes out to the family of the deceased, and my sympathies to the family of Mr. Orta, they are in for some tough times ahead. Apparently that wasn't a concern of his at the time.
