The trial continues today for Kathy Phillips, 31, who is facing murder charges and neglect of a dependent.

Testimony began Wednesday morning in Phillip's trial. Phillips has continued to deny ever being pregnant. But in opening statements Wednesday, the defense wouldn't deny or confirm a pregnancy; rather, they insisted Kathy would not murder her own infant. The defense suggested the baby was stillborn. Phillip’s defense attorney also asked the jury to consider the fact that there's a chance Kathy could have lied about not being pregnant.

During the prosecutor’s opening statements, jurors were told they’d hear from a DNA expert who says Kathy and Garry Phillips are the biological parents of the baby found at the crime scene.

The prosecution also says they have evidence that the trash bag the baby was found in matched other garbage bags that were found in a container in the Phillip’s attic. The garbage bags were obtained using a search warrant of the Phillip’s family home. The prosecutor also says they have evidence which showed Kathy Phillips was not taking birth control during the year before the baby was born.

Meantime, during cross examination of a deputy coroner, the defense points out that the baby’s death was ruled “undetermined”, not homicide.

Besides the coroner, jurors also heard from several sheriff’s deputies and detectives, who were at the crime scene when the baby was discovered.

More witnesses are expected to testify when the trial resumes Thursday morning at 8:30 C.S.T.

After two full days of jury selection, initial statements are expected to be read today. Testimony will begin once those statements are finished.

In March of 2006, Kathy’s husband, Garry Phillips, found the body of a baby girl wrapped in a towel in a plastic bag near Phillips’ house.

She was arrested in October of 2006.

The highly-publicized trial has been postponed at least three times.

Several witnesses are expected to be called during the trial including character witnesses, police detectives, and DNA experts.
