He saw a lot of lights, as well as his own life, flash before him.

Indiana State Trooper Dan Burch says his quick thinking and the bright headlights of the Ford pick-up that struck his cruiser early Sunday morning are the reason he is alive today.

He was actually standing in front of his car looking for debris the split second before it was rear-ended on US 31 just south of the US 20 By-pass.

That leap, and a lot of luck, are what saved Trooper Burch's life.

He says the driver was going above the 45 mile-per-hour speed limit and was intoxicated

Burch says, “I turned around and went walking back over to my car when I saw the headlights. It wasn't an action hero dive, just a leap out of the way. I remember the impact. I don't remember how loud it was. I just remember hearing the impact and my car being pushed beside me and there was the pick-up truck.”

There inside the pick-up truck was James Biggers of South Bend. Trooper Burch says Biggers was not injured, but he was intoxicated. The .14 BAC test result, almost twice the legal limit, was the proof. Biggers was arrested and taken to the St. Joe County Jail.

Burch says, “It's 45 miles-per-hour, and he was traveling at a decent speed. I'm not sure how fast. Apparently he wasn't going to stop. He never even hit his brakes.”

Burch says even the bright flashing lights on his car weren't stopping Biggers.

He says, “If I had froze in my tracks or hesitated, who knows. I would've been seriously injured, if not killed. He was almost in tears clutching his face saying, 'Oh my God, I can't believe I did this.'"

“The big lesson is never operate a vehicle while intoxicated. I
consider myself blessed. The Lord intervened in that situation for sure.”

This isn't the first time Biggers got behind the wheel drunk. Trooper Burch says he was convicted of operating while intoxicated in January 2003.

Yes, alcohol is a drug. Technically. And, technically, so are caffiene, aspirin, Tums, and cigarettes. All technically drugs. But, the real issue here isn't the drug, but the selfishness of the person using it. If a person takes cold medicine and drives, he is just as guilty of driving under the influence as this fool. It isn't about the use, it's about allowing it to be a detriment on society, and that is SO EASY TO STOP that it's ridiculous that it is still an issue in an age of our advanced technology&information. There are things to put onto vehicles to prevent them from starting unless you are sober. There are cab companies to call if the need arises. There are cell phones all over in case there are no pay phones or house phones, so there goes that excuse. And the old quote about not letting freinds drive drunk-TRUE, but I'd add, if you are friends with ANYONE WHO MIGHT BE ON THE ROADS, you don't let a stranger drive drunk, either!

Chris - read the story, Dan was clearing debris from the road not pulling anyone over. That section of the toll road is deadly enough without the added bonus of drunk drivers. Knowing Dan from church, we can say he is an exceptional father, husband and man. We thank God for His intervention and the family is in our prayers!!

In response to Chris in Logansport. Did you read the whole story??? Trooper Burch was stopped with his lights on picking up road debris and the drunk hit him from behind! He did not have anyone pulled over he was picking up something out of the road. You could have been in the same situation while moving that turtle that is trying to make it across the road. Only difference is that you don't have RED, WHITE and BLUE flashing lights on the back of your car. Drinking and driving = STUPID. maybe you should rally to pass a law to stop that... oh wait there is a law against that isn't there.

When are our lawmakers going to require troopers to make pull overs and investigations on side streets/roads. There is now sense in pulling someone over on a busy roadway; go 1/4 to 1/2 mile and turn off the road. This should be required so it eliminates preventable accidents...drunk driver or not. Glad he is ok, but you will never solve drunk driving, solve the troopers being on the roadsides; that can make a difference in saving lives

A Mark I used to drink and is there really a responsible drinker. You drink to alter or change you're way of thinking at that point. If you're love one ever would get killed by a drunk driver you would probably change you're thinking. Mark you probably hang out a Full Bull.

Because the driver's previous offence was more than 5 years ago, he will probably be charged with a First Offence DWI (Driving While Intoxicated) and face a fine, court costs, up to 12 months suspended driving privileges, required Alcoholics Anonymous classes and probation. Sadly, as a previous offender, he has already been through the system, but has not altered his behavior. For every drunk driving arrest, there are dozens who don't get caught. And don't think for a minute that a suspended license prevents someone from getting behind the wheel; they simply add Operating a Vehicle without a License to the list of infractions. There are inherent risks assoicated with the job of law enforcement and this incident is just one example. While the situation is unfortunate for the officer, it was probably a blessing that it was his vehicle and not a civillian's that was struck. His training and quick thinking saved his life allowing him to contiue his duty to protect and serve. Many thanks.

Wayne do you realize how many people drink responsibly. Don't take away something from everyone because a few bad apples. Here we go again trying to take more rights away from people if Wayne gets his way. Unbelieveable comment.

Suspending his license for life will not stop people like this. They have a total disregard for their life or anyone elses. I say either lock him up for life for the atempted murder of a police officer or amputate his legs so he can't reach the pedals.

I agree with troopers wife--and the driver of the truck (drunk) should be put away for a long time--not just given a slap on the hand. No trooper should have to die because someone is stupid!

Wow this is happening way too often. Bars should be required to give a breath test before you exit the building. Too high and you stay there till it is safe or check in your keys. I know it's not practice, but would at least be a start in getting the 2am drunks off the road when bars close. I like that some states use the vehicle lock out devices for convicted DUI drivers. Your car won't start unless you can pass the breath test.

You know Steve, it's sad that somebody has to die in order for you to consider it 'news' - take a look at the car. Dan stepped out of his patrol car to clear the roadway, to help prevent a potential accident from happening, and that's when the back of his car was crushed by the truck. Drive up and down the toll road and you'll see plenty of reminders of those who have perished because of drunk or drugged drivers...enough is enough. I'd much rather see news like this than another sad article about a young person losing their life due to the stupidity of others. Keep in mind, our troopers are out there on the roads to help everyone stay safe. How about paying them the respect they deserve?

I'm glad that the trooper is alright. Nice driving, Jimbo!!! I think that he (Jimbo) should pay for the repairs, not the taxpayers. Careful, Steve. That Trooper might save your life someday.
