Judge to decide if voucher program is constitutional

On Monday, a Marion County Superior Court judge will hear arguments on the constitutionality of the school voucher program in the Hoosier state.

The Indiana Choice program was passed by the General Assembly in April, but some argue it violates the state Constitution because it provides public money to schools whose main purpose is to promote religion.

A decision could be issued by the judge in January.

The program awards vouchers to parents who meet certain income qualifications.

Nearly 4,000 students took advantage of the voucher program in its first year, including more than 370 in the South Bend area.
